La pregunta decisiva es qué relación contractual se.Rule existed, why cause, how notified, and what proof.
- The company’s written dismissal notice, including cause, date and payment information.
- Payroll receipts, attendance records, communications and any disciplinary warnings.
- The applicable collective agreement, if the position is covered by one.
In Spain, Mexico, Argentina, Chile and Peru, the three-month mark has no universal legal meaning. It may matter only because it coincides with the end of a contractual trial period, a seniority threshold, or an employer’s internal assessment. The reader should not infer a right to dismissal merely because the termination occurs within that period.
Across the five countries, the same three questions organize the analysis, but the answers must be taken from each jurisdiction:
- Cause: Is there a legally recognized reason for termination, or is it a dismissal without cause? A company cannot avoid review simply by calling the termination a resignation.
- Form: Was the communication written, delivered and sufficiently clear? The required content differs between Spain, Mexico, Argentina, Chile and Peru.
- Preaviso: Does the applicable law require notice, or does it allow immediate termination in exchange for compensation? The period and the way it is calculated are country-specific.
This is a shared method, not a shared rule. Causals, deadlines and compensation depend on each country’s legislation, the employment regime and the facts. In Spain, the Estatuto de los Trabajadores provides different routes for disciplinary and objective dismissals. In Mexico, the Ley Federal del Trabajo distinguishes different grounds for termination. In Argentina, the regime for household employment has its own termination rules. In Chile, the Código del Trabajo governs notice and termination. In Peru, the Decreto Legislativo 728 is the main reference for private employment.
The first three months do not create a universal safe harbor for either side; they only invite closer scrutiny of the contract, notice and reason.
A practical decision tree starts with the documents, not with the employer’s explanation:
- Was there a trial period? Check the contract and any addendum. If no period was agreed, an early dismissal cannot be justified by invoking one.
- What reason was given? Identify whether the notice relies on a specific cause, loss of trust, abandonment, noncompliance, or no cause at all.
- Was the notice in writing? Preserve the original, its delivery evidence and any accompanying documents.
- Were payment and working documents delivered? Check whether the final settlement, certificates and benefits information were provided or requested.
- Which route applies? Use the administrative or conciliation channel in the relevant country before considering a court claim.
If a trial period existed and the employer relied on it, the central question becomes whether the stated conduct was serious, documented and compatible with the law. If the employer invoked a probation clause but the notice is silent, ask for the reasons and preserve the objection. A signed receipt of a settlement letter is not necessarily a voluntary agreement; the worker should read it before signing.
In Mexico, the Ley Federal del Trabajo is the federal starting point for private employment. The trial period must have been agreed in writing; its duration cannot exceed 30 days. During that period, either party may terminate the relationship without indemnity for the ordinary duration of the trial period.
That rule does not authorize arbitrary dismissal. The employer must still prove the facts relied on, such as failure to meet the conditions of the position, lack of suitability, or conduct that makes continuation impossible. The company’s notice should identify the reason and the effective date. If the stated facts are unsupported, the termination may be challenged.
For disputes, the Centro Federal de Conciliación y Registro Laboral is the mandatory pre-trial stage after the 2019 reform. If conciliation does not resolve the matter, the worker may approach the Tribunales Laborales del Poder Judicial. The Secretaría del Trabajo y Previsión Social offers guidance through its labor defense offices; it does not decide the dispute as a court.
The key point is not the age of the worker but the duration and proof of the trial period. A contract that merely says “probation” does not replace the written agreement and legal requirements.
The worker should check whether the notice contains:
- Employer’s identity and the date of communication.
- The contractual position and the effective termination date.
- The specific cause of termination.
- Any settlement amounts and payment dates.
- Instructions for delivering the final documents.
Keep the contract, offer letter, pay receipts, attendance records, written warnings, relevant messages and proof of delivery. Request a settlement showing salary, accrued benefits, vacation pay, holiday pay, any agreed compensation and other legally applicable concepts. Do not confuse the final settlement with a final severance payment that may not apply to a lawful termination during the trial period.
Mariana is hired in Mexico under a written trial period. Her contract begins on 1 February 2026, and the employer ends the relationship on 10 February 2026. Her salary is 12,000 MXN per month. If the employer proves the agreed trial period and a lawful reason, the termination may occur without ordinary probation indemnity.
The calculation still begins with the salary actually paid: 12,000 ÷ 30 = 400 MXN per day for this illustration. If the employer claims an amount that does not match the contractual salary, the worker should ask for the calculation. If the notice gives no reason or the documents do not support it, the worker should preserve the letter and seek conciliation before filing a claim.
In Argentina, the answer depends on the employment regime. The official guidance on household employment applies to work in private households. It should not be applied automatically to a registered employee in a company, a public worker or another arrangement.
For household employment in Argentina, the relationship can end through mutual agreement, resignation, justified cause, abandonment, death, incapacity, the employer’s retirement or death, and dismissal without cause. The notice, the reason and the consequences differ. For example, abandonment requires prior notice to the worker by a document and an opportunity to appear within 2 days; a dismissal without cause is a separate route with its own compensation rules.
The administrative authority is the Ministry of Labor, Employment and Social Security. For a registered employment dispute, the SECLO is the mandatory conciliation step in the City of Buenos Aires only. In the provinces, the pre-suit body and its name must be checked locally.
|---|---|---|---|
| Antigüedad menor a 1 año | 10 días | 10 días | 10 horas semanales remuneradas para buscar empleo |
| Antigüedad mayor a 1 año | 30 días | 10 días | 10 horas semanales remuneradas para buscar empleo |
These figures come from the Argentine household-employment regime. They should not be imported into a company contract without checking the applicable statute and agreement.
- Mutual agreement: formalized before the competent judicial or administrative authority.
- Resignation: communicated by telegram, registered letter or personal appearance before the relevant authority, with 10 days’ notice in Argentina’s household regime.
- Just cause: requires a legally recognized serious fact; the notice and evidence matter.
- Abandonment: the employer must issue a document and give the worker 2 days to appear.
- Dismissal without cause: it is not a substitute for a justified cause and may trigger the corresponding indemnity.
- Death of the worker or employer: the household guidance identifies a specific compensation of 50% of the dismissal indemnity, subject to the stated conditions.
The file should contain:
- The written notice, with its date, the reason and the effective termination date.
- Evidence of delivery: registered mail, telegram receipt or the record of a personal appearance.
- The contract and any employer rules or warnings relevant to the stated cause.
- Payroll receipts, working-time records and proof of payments.
- Any abandonment notice and the two-day appearance record.
- The calculation supporting the proposed settlement.
In Argentina, keep the original communications and avoid deleting messages. If the dispute concerns registered employment, first identify the correct local conciliation body; the SECLO applies only in the City of Buenos Aires.

Chile: cómo funciona el aviso de despido
In Chile, the Código del Trabajo governs the notice for a dismissal based on the employer’s needs. The notice must be written and given at least 30 days in advance, unless the employer pays the substitute indemnity established by law.
The Dirección del Trabajo is the administrative body that receives complaints, conducts conciliation and supervises compliance with the Code. It does not replace the Juzgados de Letras del Trabajo when the matter must go to court.
The timing rule deserves attention. Under the Chilean rule cited by the Dirección del Trabajo, the period runs in complete days: it starts at 00:00 on the day after the notice and ends at 24:00 on the thirtieth day. The employer cannot treat the hour of delivery as the beginning of the same day.
Suppose the Chilean employer delivers the written notice on 17 October at 18:00. The period begins at 00:00 on 18 October and ends at 24:00 on 16 November. The calculation is:
- Start day: 18 October, at 00:00.
- End day: 16 November, at 24:00.
- Total: 30 complete days.
If the employer does not give notice, it must comply with the substitute-indemnity rule. The worker should keep the notice, delivery evidence and payroll records. The relevant reference amount, if needed for the settlement calculation, is the last monthly remuneration; the official Dirección del Trabajo guidance confirms the computation approach.
The written notice should identify the employer and worker, the termination date, the legal cause invoked and the payment or indemnity information. In the needs-of-the-company route, the 30-day notice is central.
After receiving the notice, the worker can organize the case as follows:
- Collect the contract, payroll receipts, attendance records and the notice.
- Ask the Dirección del Trabajo for guidance on the administrative procedure.
- Use its web consultation form to ask about the case or follow the enabled procedure.
- If administrative conciliation does not resolve the dispute, consider the Juzgados de Letras del Trabajo.
- Gather the documents: contract, notice, payment receipts, working-time records and relevant messages.
- Request orientation: use the Dirección del Trabajo consultation channel and ask what administrative claim fits the facts.
- File the administrative claim: submit the claim and supporting evidence through the procedure indicated by the Dirección del Trabajo.
- Attend conciliation: appear with the documents and a clear calculation of what is claimed.
- Go to court if needed: after conciliation, consult the Juzgados de Letras del Trabajo about the remaining action and its deadline.
In Peru, private employment is primarily governed by the Decreto Legislativo 728. The Ministerio de Labor and Promotion of Employment is the reference point for confirming the applicable procedure, while SUNAFIL handles inspections and complaints about labor-law compliance.
A termination before three months does not, by itself, establish the worker’s legal position. The contract, the reason, the procedure and whether the employment was in the private or public sector must be identified. SUNAFIL can inspect compliance, but it does not declare a dismissal null; a claim seeking a remedy such as reinstatement or compensation belongs before the competent labor court under Peru’s procedural rules.
The worker should not treat a “periodo de prueba” label as a substitute for a lawful termination rule. Nor should the worker assume that an employer’s letter automatically proves the facts.
La employer’s case depends on the records and evidence supporting the stated cause.

- Identify the sector: determine whether the relationship is private, public or covered by a special regime. The private-sector reference is Peru’s Decreto Legislativo 728.
- Contact the Ministry: use the MTPE to identify the competent procedure and the documents required.
- Use SUNAFIL when appropriate: submit a complaint through SUNAFIL if there is a labor-law violation to inspect.
- Prepare the case file: include the contract, offer letter, amendments, the dismissal letter, pay receipts, attendance records, messages, warnings and proof of delivery.
- Consider conciliation: if the issue is not resolved administratively, check the applicable conciliation route in Peru before approaching the Juzgados de Trabajo.
Suppose a private-sector worker in Peru signs a contract with a trial period and is dismissed on day 20. The contract states a monthly salary of 4,000 PEN and does not include a clear indemnity clause. The employer sends only “termination of the relationship,” without explaining the cause.
The worker should not add an indemnity calculation from Mexico, Chile or Spain. First calculate the salary basis: 4,000 PEN ÷ 30 = 133.33 PEN per day as an arithmetic reference for the stated contract. Then check whether the applicable Peruvian rule and the facts support termination without compensation or require another consequence. The MTPE and the applicable case file must establish the route; SUNAFIL can inspect compliance, while the labor court resolves a judicial claim.
When the notice lacks a reason, the safest approach is to preserve the document, request the applicable procedure from the Peruvian authority and avoid signing a settlement before understanding its effects.
The data in this article were checked in November 2026. The legal routes and monetary figures described here should be matched to the country, regime and facts of the specific case before taking action.
