Divorce legal: how it works and what changes from country to country

La similarity does not extend to the paperwork.

España: divorcio judicial, notarial y efectos patrimoniales

In Spain, divorce follows the Real Decreto de 24 de julio de 1889 — Código Civil and, when the case is judicial, the Ley 30/1981, de 7 de julio, por la que se modifica la regulación del matrimonio en el Código Civil. The courts decide the divorce and approve the measures concerning children, financial support and use of the family home.

For a mutual-consent route, a notary can prepare the divorce when the legal requirements are met, including the absence of children in the situation that prevents using that route. A court route is also available. In contentious cases, each spouse must have a lawyer and a court representative.

Ventajas: mutual consent allows the spouses to organize the agreement directly; the judicial route can resolve disputes; both routes address financial and parental matters.

Inconvenientes: the agreement must be complete and workable; disagreement over children, money or property can require a longer judicial process; the economic result depends on the applicable property regime and the court’s assessment.

España: las vías para pedir el divorcio

Vía en España Requisitos diferenciados Resultado principal
Mutuo acuerdo judicial Both spouses request divorce and submit an agreement on the applicable measures. The court approves the divorce and the agreed measures, after checking the agreement and the children’s situation.
Administrativo notarial Mutual consent, the legal requirements for the notarial route, and the required agreement. The notary formalizes the divorce and the agreement in the corresponding notarial instrument.
Contencioso One spouse acts without the other’s consent, or the relevant effects remain disputed. The court decides the divorce and resolves the disputed measures under Spanish law.

In Spain, the agreement commonly addresses the following matters:

  • Children: custody, ordinary and extraordinary expenses, holidays and the communication schedule.
  • Parental responsibility: coordination of decisions and how major issues will be handled.
  • Financial support: contributions for children and, when appropriate, a compensatory pension.
  • Family home: ownership, assignment of use, expenses and whether sale is prevented during a defined period.
  • Property: the distribution or rules for liquidation of assets under the applicable property regime.
  • Other practical matters: healthcare, school, travel and extraordinary expenses.

The document should be drafted with the real situation of the family in view. A formula copied from another case may not cover current income, custody needs or the condition of the home.

In Spain, “divorce exprés” is a colloquial expression. It does not create a special legal procedure. The notarial route still requires mutual consent and compliance with the legal conditions; the judicial route still requires the court’s decision.

The same caution applies to the expression “quick divorce”: it may describe a simple procedure, but it does not remove the need to agree on children, support, the home or property. If those matters remain unresolved, they have to be decided by the competent court.

México: requisitos,lds sus sus, flexible

In Mexico, divorce is governed by the civil and family rules of the relevant state. The Código Civil Federal is a reference in federal matters, but divorce proceedings normally take place before the family courts of each entity. The competent authority and the procedure must therefore be confirmed locally, through the Poder Judicial de la Nación or the state judiciary.

The practical requirements may include:

  • Identification and proof of the marriage.
  • Addresses and contact information of the parties.
  • Birth certificates of any children and information about their residence.
  • A proposal about custody, support and communication when there are children.
  • Information about the property regime, debts and the family home.
  • In contested cases, the evidence and pleadings required by the state procedure.

Mexico’s divorce is flexible in practice, but not procedurally uniform. A judge may authorize or refuse the divorce, and the effects of the judgment must be implemented through the competent local authority.

México:/causa

  1. Identify the state and the family court in Mexico. The territorial rules and the court’s procedure determine the route.
  2. Prepare the initial application in Mexico. Include the marriage and identity documents, the children’s information if applicable, and the proposed measures. The specific documents are set by the state’s law and the court’s instructions.
  3. Complete the summons and hearing stages in Mexico. The state rules determine whether a appearance, conciliation or evidentiary hearing is required and how the other spouse is notified.
  4. Obtain and comply with the resolution in Mexico. The judgment or administrative equivalent must be presented for registration and execution where required by the state procedure.

The timing varies by entity and by the procedural stage; no single national filing period can be stated without knowing the state and the route.

México: hijos, alimentos y patrimonio

Matter in Mexico Legal focus Point to confirm locally
Parental responsibility The parents’ responsibilities for care, education and decisions remain central to the family proceeding. The state code and the judgment concerning custody, support and communication.
Child support The contribution must be tied to the child’s needs and the parents’ capacity. The state rules, the needs assessment and the payment or enforcement procedure.
Property and debts The applicable property regime and the date of the marriage determine how assets and liabilities are addressed. The state’s civil and family rules, plus the property documents and the court’s liquidation process.

In Mexico, the rules and authorities vary by state. Before starting, ask the family court or its official information office for: the current divorce route, the documents accepted, the rules for children and support, the property regime and the procedure for enforcing the judgment. Request the rules in writing or through the court’s official channel, and do not assume that a procedure from another state will be accepted.

En Mexico, “elffyourtfamily court” means the state procedure; it does not mean a universal national divorce form.

Argentina: divorce unilateral, joint por acuerdo y compensation económica

In Argentina, the Ley 26994 — Código Civil y Comercial de la Nación provides that divorce does not require a cause or a waiting period measured from the wedding. One spouse may request it; both may also file jointly.

The petition must include a regulatory proposal covering the family home, distribution of assets, support, children’s care and communication, and any economic compensation. If the parties disagree about the proposal, that disagreement does not prevent the court from granting the divorce; the court can resolve the disputed effects.

The court is the relevant body. For family matters in Argentina, the Juzgados Nacionales y Provinciales en lo Civil (fuero de familia) are the institutional reference.

Argentina: la propuesta reguladora y sus efectos

In Argentina, the agreement or judicial decision can organize:

  • The family home: continued use, rent, restrictions on sale and the duration of the arrangement.
  • Property: division of assets and treatment of debts under the applicable property regime.
  • Child support and extraordinary expenses.
  • Parental care, communication and a parenting plan.
  • Economic compensation when the legal requirements are met.

The court may assign use of the family home to the economically weaker spouse, particularly when that spouse cares for the children, taking into account health, age and the family’s interests.

Argentina: compensación económica y plazos

In Argentina, economic compensation is intended to address an economic imbalance caused by the divorce. It may take the form of a lump sum, periodic payments, usufruct of an asset or another legally appropriate arrangement.

The request must be made within 6 months from the divorce judgment in Argentina. The figure comes from the official Argentine legal information service. If there is no agreement, the judge assesses the circumstances, including the assets at marriage and divorce, family work, children, age, health and earning capacity.

Argentina:بيت Prestaciones y distribución de bienes

Item in Argentina Distinction General rule
Support for the former spouse It is not the same as economic compensation. It is limited to the cases recognized by the Code, including serious preexisting illness that prevents self-support or lack of own resources, subject to the stated duration limit and without duplication with compensation.
Economic compensation It responds to an economic imbalance after divorce. It may be paid in a lump sum, as income, usufruct or another agreed or judicial form.
Property and the home The property regime controls the starting point. The court may assign use of the family home, order a compensating rent or restrict sale or partition under the applicable rules.

In Chile, divorce is heard by the Tribunales de Familia. The main routes are mutual agreement, unilateral divorce based on cessation of cohabitation and divorce for fault.

The Corporación de Asistencia Judicial provides free legal advice to people who need to process a divorce. After a socioeconomic assessment, a person without resources may receive free judicial representation.

For a concrete example, imagine two spouses in Chile who separated three years ago, have one child and cannot agree on the holiday schedule. If the facts meet the relevant requirements, the spouse seeking the divorce may use the unilateral cessation-of-cohabitation route; the child’s direct and regular relationship with both parents must still be addressed in the case.

Chile: qué exige cada vía de divorce

Route in Chile Main requirement Information to confirm
Mutual agreement Cessation of cohabitation for more than 1 year and a joint request by both spouses. The agreement on children, support and property, and the court’s approval.
Unilateral by cessation of cohabitation Cessation of cohabitation for more than 3 years; either spouse may sue. Evidence of separation and non-resumption of the marriage.
For fault A serious and qualified fault that makes living together intolerable; there is no waiting period. Evidence supporting the cause and the information required for the claim.

For Chile, the basic documents commonly requested are:

  • Marriage certificate and marriage record.
  • Birth certificates of the children, if any.
  • Certificate of cessation of cohabitation, or the record that it was notified to the other spouse, where required.
  • At least 3 adult witnesses for the relevant cessation-of-cohabitation information, including identification and contact details.
  • Documents on support, direct and regular relationship with the children and personal care, if children are involved.
  • Full name, address and occupation or profession of both spouses, plus identity-card copies.

The ChileAtiende divorce advisory service is a practical starting point. The Tribunales de Familia receive the case through the appropriate procedural channel.

Chile: efectos del divorce sobre hijos ycriptors

In Chile, the case must address:

  • Child support and extraordinary expenses.
  • Personal care or custody, according to the applicable family rules.
  • Direct and regular communication with the parents.
  • The child’s residence and holiday arrangements.
  • Other agreements needed for the child’s stability.

Where mediation is required for child-support, personal-care or direct-and-regular-relationship matters, the parties should comply with that step before the court decides the disputed issue.

Perú: divorce y

In Peru, divorce is regulated principally by the Decreto Legislativo 295 — Código Civil and the family-court procedure. The ordinary route is judicial. A mutual-consent route can be handled through a municipality or notary under the Ley 29227 — Regula el Procedimiento No Contencioso de la Separación Convencional y Divorcio Ulterior en las Municipalidades y Notarías, when the legal conditions are met.

The Poder Judicial and its family courts are the relevant judicial institutions. For a no-contentious route, confirm the exact municipal or notarial procedure in the place where the divorce is being processed.

In Argentina, divorce is generally unilateral, so the other spouse’s opposition does not prevent the divorce itself. In Spain, the notarial route requires mutual consent, while a contested divorce is decided judicially. In Mexico, Chile and Peru, the requirements depend on the applicable route and local procedure.

In Spain, Chile, Mexico, Argentina and Peru, the court can decide matters concerning care, support and communication when the spouses cannot agree. The exact terminology and procedure differ by country, but the child’s best interests are central to the family decision.

¿Es obligatorio pedir una compensación económica?

In Argentina, compensation is not automatic: it requires the legal conditions and must be requested within 6 months from the divorce judgment. Other countries may use different mechanisms for addressing economic inequality, so the applicable local law must be checked.

They’ve agreed that Diego will stay in the family home and pay support.

Suppose Karla and Diego live in Monterrey, Mexico, have been married for 4 years and have one child. Karla earns 12,000 pesos mexicanos per month and Diego earns 18,000 pesos mexicanos per month. They agree that Diego will remain in the family home and that he will pay 2,400 pesos mexicanos per month toward the child’s expenses.

The calculation is simple: 12,000 pesos mexicanos + 18,000 pesos mexicano = 30,000 pesos mexicanos of household income, before taxes or other deductions. The proposed child support of 2,400 pesos mexicanos represents 8% of that total income. This is not a legal tariff or a forecast of what a judge would order in Mexico: it is only an illustration of how to test a proposal against the family’s income and documented child expenses. The family court in the relevant Mexican state must decide whether the agreement and the support arrangement are appropriate.

Before signing, do not use a template from another country or sign an agreement about children, money, the home or property without confirming the local law and the competent authority. A wrong forum or an incomplete agreement can postpone the process and create a new dispute.
