Its practical function is to individualize the facts: what happened, when, where, which obligation was breached, and why the conduct justifies termination. It also fixes the date of the decision and the date of its effects, if applicable, and explains the economic settlement or the route for contesting the dismissal.

A cause that is not adequately explained can create procedural and economic risk. If the company cannot prove the cause or has introduced a new reason in court, it may face an unjust dismissal ruling and the corresponding compensation. In Spain, for example, the employer is bound by the cause stated in the letter; in Argentina, imprecise accusations may fail to configure the disciplinary cause; and in Chile, the letter must identify the legal cause and the concrete facts supporting it.

The document must be drafted with care, but it is not a substitute for legal advice. The right question is not whether the wording sounds severe, but whether each fact can be proved and legally justifies the termination.

El principio común y por qué cambia en cada país

Across Spain, Mexico, Argentina, Chile and Peru, the common principle is that the employer must have a legally valid cause, communicate the decision and give the worker information that allows them to defend themselves. The details are not universal:

  • The legal name of the document changes: in Spain it is the carta de despido; in Chile, the carta de aviso de término de contrato; in Mexico and Peru, the terminology depends on whether the termination is individual, consensual or governed by a specific proceeding.
  • The accepted grounds change: Spain distinguishes between disciplinary dismissal and dismissal for objective causes; Chile separates conduct without liability, serious conduct and business needs; Argentina focuses on injuria under its labour contract law; Mexico and Peru require the employer to connect the facts with a legal termination ground.
  • The notice period, compensation and formula for calculation change completely by country.
  • The challenge route also changes: Spain begins with conciliation before the SMAC; Mexico uses the Centre for Conciliation and Labour Registry before a labour court; Argentina uses the SECLO only in the City of Buenos Aires; Chile offers administrative action before the labour court; and Peru begins with administrative inspection or conciliation, depending on the claim, before the labour court.

The safest card is the one that proves what happened, states the applicable legal ground and does not rely on a generic label such as “serious misconduct”.

España: carta de despido disciplinario y por causas objetivas

In Spain, the Real Decreto Legislativo 2/2015, de 23 de octubre, Estatuto de los Trabajadores regulates the two main unilateral dismissals described below. The disciplinary dismissal requires serious and culpable conduct. The dismissal for objective causes requires a reason connected with the company’s economic, technical, organisational or productive situation, and generally includes preaviso and compensation.

The letter must identify the facts, the legal ground and the date of effects. In Spain, under art. 105 of the Ley Reguladora de la Jurisdicción Social, the company cannot rely in court on a cause different from the one expressed in the letter. This is why adding “repeated absenteeism, disobedience and loss of confidence” to a letter that proves only one late arrival is dangerous.

Cuándo procede un despido disciplinario en España

In Spain, disciplinary dismissal may be appropriate for serious and culpable conduct, such as repeated unjustified absence, disobedience, offences, abuse of confidence or a deliberate and sustained fall in performance. The facts must be linked to the conduct attributed to the worker and to the seriousness of the breach. A label without evidence is not enough.

The main advantages of a disciplinary dismissal are that it does not require preaviso and normally does not entail the same compensation as a dismissal for objective causes. Its main inconvenience is the risk of the company being ordered to pay the corresponding compensation if the conduct is not proven or is not sufficiently serious.

Spain: disciplinary dismissal Effect
Preaviso None under the statutory rule communicated in this article
Compensation in the letter No objective-cause compensation is stated; the settlement of accrued salary and other employment entitlements is still assessed
Main judicial risk The company must prove the serious and culpable conduct stated in the letter
Less severe alternative A warning, suspension or another proportionate disciplinary measure, where legally available and appropriate

A disciplinary letter should therefore describe the date, place, conduct, obligation affected and prior warnings or disciplinary background. It should distinguish what the worker did from the company’s conclusion that the conduct is serious. The employer should also check whether a less severe measure would be more appropriate.

Despido por causas objetivas en España

In Spain, the dismissal for objective causes can be based on economic, technical, organisational or productive causes. Economic causes include current or foreseeable losses or a persistent decrease in income. Technical causes concern changes in production methods or technology. Organisational causes concern changes in work systems or production. Productive causes concern changes in demand for products or services.

Spain: dismissal for objective causes Statutory data
Preaviso Minimum 15 days
Compensation 20 days of salary for each year worked, capped at 12 monthly payments
Requirement in the letter The cause and the availability of compensation
Source Estatuto de los Trabajadores, Spain, art. 53.1

If the 15-day preaviso is not observed, in Spain the company must pay the corresponding salaries. If the worker has an earlier contract, the applicable calculation must be checked separately because periods before 12 February 2012 have a different treatment for an ultimately unjust dismissal.

Plazos, impugnación y organización en España

In Spain, the worker has 20 working days from the date of effects of the dismissal to file the conciliation slip before the Servicio de Mediación, Arbitraje y Conciliación (SMAC). Conciliation is a mandatory prior step before a labour claim is filed in the Juzgados de lo Social.

The type of dismissal changes the result:

  • Dismissal for disciplinary cause: if the cause is proven, the dismissal is normally justified; if it is not, the company faces the consequences of an unjust dismissal.
  • Dismissal for objective causes: the company must prove the existence of the objective cause and compliance with the procedural requirements.
  • Unjust dismissal: the company must choose between readmission with the corresponding processing salaries or the statutory compensation.

The company should retain proof of delivery, the complete letter, any attachments and evidence of the grounds. Delivery by hand with a signature receipt, burofax with acknowledgement, or another legally reliable method may be used. If the worker refuses to sign, the employer should document the refusal and preserve evidence of delivery.

Indemnización por despido improcedente en España

In Spain, an unjust dismissal gives the company two principal options: readmission with the corresponding processing salaries, or compensation of 33 days of salary for each year worked, capped at 24 monthly payments. For contracts before 12 February 2012, the calculation is split: 45 days per year for the earlier period and 33 days per year for the later period, with an overall cap of 720 days of salary.

Example for Spain: if a worker with 2 years of service is dismissed and the court declares the dismissal unjust, the company can pay 33 days of salary for each year worked, or readmit the worker and pay the processing salaries. The result depends on the court’s decision and the employer’s lawful choice; it is not a settlement the worker can impose unilaterally.

Spain: unjust dismissal Rule
Option 1 Readmission with the corresponding processing salaries
Option 2 33 days of salary per year worked, maximum 24 monthly payments
Period before 12 February 2012 45 days per year for that period, subject to the joint 720-day cap
Period from 12 February 2012 33 days per year, subject to the joint 720-day cap

In Spain, the letter fixes the legal battlefield: the employer must prove the cause written there and cannot later replace it with another reason.

México: carta documento de despido con causa

In Mexico, the Ley Federal del Trabajo provides the federal framework for termination of employment. The document may take different forms depending on the situation, including an individual dismissal communication or the documents used in a consensual termination. The employer should therefore identify the legal mechanism before drafting the letter.

The Instituto Mexicano del Seguro Social (IMSS) administers registration, contributions and social-security benefits; it does not decide the dismissal or pay the finiquito. The Secretaría del Trabajo y Previsión Social (STPS) handles labour inspection and, through its labour defence office, provides free advice and representation to workers. The ordinary judicial route starts with conciliation at the Centro Federal de Conciliación y Registro Laboral (CFCRL); if that fails, the claim goes to the Tribunales Laborales del Poder Judicial.

The material consulted does not provide a single national formula for every amount or deadline in Mexico. In particular, the amounts depend on the wages, the cause, the worker’s status and the applicable federal or state rules. The letter should not contain a guessed figure.

In Mexico, the letter must connect the termination with a cause recognised by the Ley Federal del Trabajo and explain the facts that support it. Generic phrases such as “breach of company rules” are weaker than a dated description of the conduct, the rule involved and the evidence available.

The main advantage of documenting the cause is that it allows the employer to show that the decision was based on a lawful ground and not on discrimination or retaliation. The main inconvenience is that a detailed letter becomes discoverable evidence in a labour dispute. The employer should include only relevant facts, avoid retaliation language and preserve supporting records.

Mexico: dismissal communication What must be checked
Legal basis The termination mechanism under the Ley Federal del Trabajo
Facts Dates, place, conduct, affected obligation and evidence
Amounts Only amounts supported by the applicable wage, period and legal rule
Administrative stage Conciliation at the CFCRL before the labour court
Social security The IMSS handles registration and benefits, not the dismissal decision

Indemnización, finiquito y ancillada en México

In Mexico, the finiquito settles the employment relationship and includes the amounts that correspond to the case, such as salary, accrued benefits and other legally recognised entitlements. The finiquito is not the same as social-security registration or the payment of a pension: the IMSS manages the latter through its own procedures.

Mexico: glossary Meaning and authority
Finiquito Settlement of the employment relationship; the employer calculates the amounts under the applicable law and the worker’s records
Indemnización Amount linked to the legal cause of termination; its amount depends on the case and cannot be stated from the material consulted
IMSS Social-security authority; it does not determine whether the dismissal is lawful
Amounts not verified “Sin dato en las fuentes consultadas”
Deadlines not verified “Sin dato en las fuentes consultadas”

The employer should reconcile the payment receipt with the final payroll, explain each deduction and obtain the worker’s receipt. If the worker does not sign, the employer should document delivery and keep the evidence of the calculation. The legal authority that reviews an objection is the labour court after the conciliation stage, not the IMSS.

Entrega, prueba y reclamación en México

In Mexico, the delivery of the communication must be documented. A practical checklist is:

  • Identify the employer, worker, contract, legal cause, facts and date of termination.
  • Attach the calculation of the finiquito and identify any indemnity separately.
  • Deliver the letter personally where possible and obtain a dated receipt; if the worker refuses, use a reliable delivery method and preserve its evidence.
  • Keep the personnel file, payroll records, disciplinary evidence and proof of payment.
  1. In Mexico, the worker seeks free advice from the STPS if necessary.
  2. In Mexico, conciliation begins at the CFCRL or the competent state conciliation body, depending on the case.
  3. If conciliation does not succeed, in Mexico the worker files the claim before the Tribunal Laboral.
  4. In Mexico, the worker keeps the letter, delivery evidence, payroll records, finiquito receipt and conciliation documents.

The consulted material does not establish one universal deadline for this route in Mexico, so the exact procedural step must be confirmed according to the employer’s jurisdiction, the nature of the claim and the documents available.

Argentina: carta documento de despido con causa

In Argentina, the Ley de Contrato de Trabajo 20.744 governs the disciplinary dismissal. The Ley 23789 provides the framework for the telegram and document addressed to workers, pensioners and retirees. A telegram or letter must therefore state the conduct and the legal basis with precision.

The Secretaría de Trabajo, Empleo y Seguridad Social provides labour guidance and handles registered-work enforcement. Before filing a claim in the City of Buenos Aires, the worker must use the SECLO; in the provinces, the prior instance has a different name and authority. If conciliation does not resolve the dispute, the case goes to labour justice.

The employer’s main problem is not merely sending the communication quickly. It is demonstrating that the conduct was sufficiently serious to justify dismissal and that the facts communicated were not vague accusations.

Requisitos de la causal disciplinaria en Argentina

In Argentina, art. 242 of the Ley de Contrato de Trabajo 20.744 requires an breach of the worker’s obligations that constitutes injuria and is serious enough to prevent the relationship from continuing. The seriousness is assessed prudently according to the nature of the relationship and the personal circumstances.

Not every labour breach supports dismissal. The employer should examine the seriousness of the conduct, the worker’s seniority, the disciplinary record, the relationship between the parties and whether a warning or suspension would have been a more proportionate response. A first minor breach should not automatically be treated as a dismissal case.

Argentina: disciplinary cause Practical question
Conduct Which specific obligation was breached?
Seriousness Is the conduct serious enough to make continuation of the relationship impossible?
Evidence Can the employer prove time, place and manner?
Proportionality Has a less severe measure been considered?
Defence Has the worker been informed sufficiently to answer the allegations?

Individualización de los hechos en la carta argentina

In Argentina, a useful example would be: “On 12 May 2026, at 10:00, during the inventory meeting in aisle 4, the worker refused to follow the safety procedure, spoke to a colleague using an explicit threat and then left the area without authorisation.” This is stronger than “the worker was disrespectful and showed bad conduct”.

The CNTrab., sala VI, in “Urristi, Julián Matías c. Extin Red S. A. y otro s/Despido”, judgment of 20 March 2024, held that a communication using only “falta de respeto”, “insultos” and “malos tratos” was too vague because it did not individualise the conduct. The judgment does not require a literal transcript of every insult; it requires an adequate explanation of the behaviour attributed to the worker.

Argentina: vague wording More defensible description
“Insultos” Date, place, words or conduct attributed, context and source of evidence
“Malos tratos” Exact behaviour and circumstances
“Incumplimiento” The obligation affected and the facts showing non-compliance
“Falta de respeto” Conduct capable of being examined by the worker

The advantage of precision is that it protects the worker’s ability to answer and gives the employer a usable evidentiary record. The inconvenience is that the employer must investigate before sending the letter and cannot rely on general conclusions.

Decisión previa a la communication y defensa del trabajador

Before sending an Argentine dismissal communication, the employer should complete this checklist:

  • Identify the exact conduct, the affected obligation and the evidence.
  • Check prior warnings, the disciplinary record, the worker’s seniority and the seriousness of the breach.
  • Consider whether suspension, a written warning or another lesser measure would be proportionate.
  • Prepare the communication in a format permitted by the applicable procedure, including a telegram or document.
  • Preserve proof of delivery and attach the supporting evidence.
  1. In Argentina, assess whether the conduct meets the seriousness required by art. 242 of the Ley de Contrato de Trabajo.
  2. In Argentina, draft the communication with the individual facts and the worker’s right to respond in mind.
  3. In Argentina, deliver it through a legally reliable procedure and keep the receipt or delivery evidence.
  4. In Argentina, explain the conciliation or judicial route according to the province and the claim.

Urgency does not replace legal analysis. A rushed letter can lock the employer into an imprecise cause and make later correction difficult.

Chile: carta de aviso de término de contrato

In Chile, the DFL 1, Código del Trabajo sets the labour framework. The employer communicates the termination through a written carta de aviso de término de contrato. The Dirección del Trabajo is the first administrative route: it receives complaints, conducts inspections and offers conciliation. If the dispute continues, the claim goes before the Juzgados de Letras del Trabajo.

The finiquito must be granted before a ministro de fe, normally a notary or an inspector of the labour authority. It records the settlement of the employment relationship. The communication should identify the causal category, the concrete facts and the applicable notification deadline.

Causales y contenido de la carta en Chile

In Chile, the letter should distinguish three broad categories: termination without liability of either party, serious conduct by the worker, and needs of the company. The first includes mutual agreement, voluntary resignation, expiry of the contract and completion of the work for which the worker was hired. The second includes serious failures such as dishonesty, harassment, abandonment and conduct endangering safety. The third includes changes in market conditions, lower productivity or modernisation processes.

The contents should include:

  • The legal category applied.
  • The concrete facts and their dates.
  • The date of the decision and the date of separation.
  • The indemnity, if applicable, and the settlement of final labour entitlements.
  • The status of social-security contributions up to the last day of the month before dismissal, with the relevant vouchers.
  • Whether the finiquito will be delivered in person or electronically. The worker may always choose the in-person route before a ministro de fe.

In Chile, the three categories are not interchangeable. A serious-conduct dismissal and a dismissal for business needs have different consequences, and the company should not use the second merely to avoid analysing the first.

Plazos de preaviso en Chile

In Chile, the notification periods communicated by the Dirección del Trabajo are:

Chile: cause Notification deadline
Needs of the company or desahucio At least 30 days’ notice
Serious fault or expiry of the contract Within 3 working days after the last working day
Force majeure or fortuitous event 6 working days from the separation

The deadline must be calculated from the relevant event. For business needs, the company should give the notice at least 30 days before the termination. For serious fault, it should notify within 3 working days after the last working day. For force majeure, it should notify within 6 working days from separation. Failure to comply can lead to administrative consequences.

Finiquito y reclamación en Chile

After the termination communication, in Chile the employer grants the finiquito before a ministro de fe. The documents should include the finiquito, proof of payment of social-security contributions and evidence of delivery of the letter.

  1. In Chile, deliver the carta de aviso de término de contrato personally or by certified mail, and send a copy to the competent Inspección del Trabajo.
  2. In Chile, grant the finiquito before a ministro de fe and provide the worker with the settlement and contribution evidence.
  3. In Chile, if there is a dispute, submit the claim before the Dirección del Trabajo for administrative processing and conciliation.
  4. In Chile, if the matter is not resolved, file the claim before the Juzgado de Letras del Trabajo.

In Chile, the worker has 60 working days from dismissal to claim before the labour courts or the Inspección del Trabajo. If the claim is submitted to the Inspección, the period is suspended, without exceeding 90 working days in total from separation. This is the procedure described for this dismissal communication, not a universal rule for every labour claim.

Dato a tener en cuentaEl plazo de días hábiles
El cómplice sólo cuenta días hábiles, por lo que conviene preparar la conciliación antes de que venza el plazo en España.

Perú: carta de despido con causa

In Peru, private-sector employment is governed mainly by the Decreto Legislativo 728, Ley de Fomento del Empleo. The written communication must explain the termination ground and the facts that support it. The relevant administrative authority is the Superintendencia Nacional de Fiscalización Laboral (SUNAFIL), which can inspect and investigate labour infringements, although it does not declare the dismissal null.

A worker who challenges the dismissal may proceed through conciliation and then the Juzgados de Trabajo del Poder Judicial. SUNAFIL, the Ministry of Labour and the labour court have different functions: inspection, administrative conciliation and judicial resolution respectively.

The consulted material does not establish one national amount or deadline for every dismissal with cause in Peru. Any figure must therefore be checked against the applicable law, the worker’s remuneration, the length of service and the specific case rather than presented as a fixed national amount.

Causal, hechos y expediente en Perú

In Peru, the causal must appear in the written communication and the employer should keep an expediente capable of demonstrating it. The dossier should contain:

  • The employment contract, position and working period.
  • The rule or obligation allegedly breached.
  • Detailed incident reports, with date, place, people involved and conduct attributed to the worker.
  • Prior warnings and disciplinary measures, if they exist.
  • Evidence supporting the decision, kept separately from the letter itself.
  • The communication receipt, the settlement and proof of payment.

The facts should be stated without exaggeration. If a worker allegedly made a threat, the letter should identify the words or conduct, the context and the evidence; it should not state conclusions that the dossier cannot prove. This allows the worker to answer and the authority to examine the employer’s decision.

Peru: document Purpose
Employment contract Identifies the relationship and the applicable contractual context
Incident report Establishes time, place and conduct
Evidence file Supports the factual allegations
Written communication States the cause, decision and date of effects
Settlement and receipt Demonstrate what was paid and how the documents were delivered

Finiquito y liquidación en Perú

In Peru, the liquidación final records the employment amounts that close the working relationship according to the applicable rules and the documents in the file. The concept of indemnización depends on the legal route of the termination: it is not automatically the same as the final settlement.

Peru: glossary Treatment
Liquidación final Settlement of the amounts arising from the employment relationship
Indemnización Amount linked to the applicable termination route and the facts of the case
SUNAFIL Administrative inspection; it does not declare the dismissal null
Labour court Decides a contested dismissal and the corresponding remedy
Amounts not verified “Sin dato en las fuentes consultadas”
Deadlines not verified “Sin dato en las fuentes consultadas”

The employer should provide a clear statement of the amounts paid and deductions made. The worker should receive the settlement and supporting evidence. If the figures are calculated using a variable such as the UIT or the worker’s remuneration, the applicable year and the official source must be checked at the time of calculation; no universal amount should be assumed.

Notificación y vías de impugnación en Perú

In Peru, delivery and the reaction to the dismissal should be documented in the following sequence:

  1. In Peru, issue the written communication with the cause, the facts, the decision date and the date of effects.
  2. In Peru, deliver it through a reliable method and preserve the receipt or delivery evidence.
  3. In Peru, prepare the liquidación final and the supporting payment and contribution records.
  4. In Peru, if the worker challenges the dismissal, the administrative route may begin through SUNAFIL or the competent conciliation body, depending on the claim.
  5. In Peru, if the dispute is not resolved, the worker may file the case before the Juzgados de Trabajo.

The exact administrative deadline and the documentation required for a particular objection in Peru are “sin dato en las fuentes consultadas”. The key legal distinction is stable: SUNAFIL investigates or enforces administrative obligations, while the labour court decides the contested dismissal and any indemnity or reinstatement claim.
